Terms of Service

1 Definitions

In these Terms of Service, the following terms have the meanings set out below:

• "Service" means the Creatinsta PPC & Social Dashboard, a web-based analytics platform accessible at the URL provided by Creatinsta, including all features, tools, and updates.
• "Creatinsta", "we", "us", or "our" means Creatinsta Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság, registered in Hungary, with tax number 14145757-2-07, having its registered office at 8130 Enying, Erkel Ferenc utca 1/A, Hungary.
• "Agency" means a business entity that accesses the Service under an agency role to manage one or more client accounts.
• "Client" means a business or individual whose advertising and social media data is managed through the Service by an Agency.
• "User" means any individual who accesses or uses the Service, whether as an Agency administrator, Agency team member, or Client.
• "Account" means a registered account on the Service associated with a User's email address.
• "Third-Party Platforms" means external advertising and analytics platforms connected to the Service, including but not limited to Meta (Facebook/Instagram), Google Ads, TikTok, Google Analytics 4, and WooCommerce.

2 Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

3 Service Description

The Creatinsta PPC & Social Dashboard is a software-as-a-service (SaaS) platform that enables marketing agencies to:

• Connect and aggregate paid advertising data from Meta Ads, Google Ads, and TikTok Ads;
• View and analyse organic social media analytics from Facebook Pages, Instagram Business accounts, and TikTok profiles;
• Monitor website analytics through Google Analytics 4 and WooCommerce integrations;
• Configure and track key performance indicators (KPIs) per client;
• Generate performance reports and share read-only dashboard views with clients.

The Service is intended exclusively for professional use by marketing agencies and their business clients. It is not a consumer product.

Creatinsta reserves the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

4 Account Registration and Eligibility

To use the Service, you must:

• Be at least 18 years of age;
• Be a duly authorised representative of a business entity;
• Provide accurate, complete, and current registration information;
• Maintain the security of your login credentials and not share them with unauthorised persons.

You are responsible for all activity that occurs under your Account. You must notify Creatinsta immediately at hello@creatinsta.agency if you become aware of any unauthorised use of your Account.

Creatinsta reserves the right to refuse registration or to suspend or terminate any Account at its sole discretion.

5 User Roles and Responsibilities

Agency Administrators are responsible for:

• Creating and managing their team members' access within the Service;
• Ensuring that all team members comply with these Terms;
• Connecting Third-Party Platform credentials on behalf of the Agency;
• Configuring client accounts and controlling the data visible to each Client user.

Agency Team Members access the Service under the permissions granted by the Agency Administrator and are bound by these Terms in their own right.

Client Users are granted read-only access by the Agency to view their own dashboard data. Clients may not modify account settings, API credentials, or configuration unless explicitly granted such permission by the Agency Administrator.

Agencies are solely responsible for obtaining any consents required to connect a client's Third-Party Platform accounts to the Service and for ensuring that their use of client data complies with applicable law.

6 Third-Party Platform Integrations

The Service relies on OAuth authentication and API integrations to retrieve data from Third-Party Platforms. By connecting a Third-Party Platform, you:

• Authorise Creatinsta to access and store API tokens and data from that platform on your behalf;
• Confirm that you have the right to grant such access, either as the account owner or as an authorised representative;
• Acknowledge that the availability and accuracy of data is subject to the Third-Party Platform's API terms, rate limits, and data availability.

Creatinsta is not responsible for any interruptions, data gaps, or errors arising from changes to Third-Party Platform APIs, policy changes, or the revocation of access tokens.

Your use of data retrieved from Third-Party Platforms must comply with each platform's own terms of service, including but not limited to the Meta Platform Terms, Google API Services User Data Policy, and TikTok for Developers Terms of Service.

7 Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, including data protection laws;
• Connect accounts for which you do not have authorisation;
• Attempt to gain unauthorised access to any part of the Service, its servers, or connected systems;
• Introduce malware, viruses, or any other harmful code;
• Scrape, reverse-engineer, or decompile the Service;
• Resell, sublicense, or otherwise commercialise access to the Service without Creatinsta's prior written consent;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

Creatinsta may suspend or terminate access immediately and without notice if it reasonably believes a violation of this section has occurred.

8 Intellectual Property

The Service, including its software, design, interface, documentation, and all related content, is the exclusive property of Creatinsta and is protected by Hungarian and international intellectual property laws.

These Terms do not grant you any ownership rights in the Service. You are granted a limited, non-exclusive, non-transferable licence to use the Service solely for your internal business purposes in accordance with these Terms.

You retain ownership of all data you input into the Service and all data retrieved from Third-Party Platforms on your behalf. By using the Service, you grant Creatinsta a limited licence to process that data solely for the purpose of providing the Service to you.

9 Data and Privacy

Creatinsta processes personal data in connection with the Service in accordance with its Privacy Policy, which is incorporated into these Terms by reference.

Creatinsta acts as the data controller for personal data of Users (e.g. name, email address, login information). Creatinsta acts as a data processor with respect to any personal data contained within Third-Party Platform data retrieved on your behalf.

You are responsible for ensuring that any personal data you provide to the Service or authorise Creatinsta to retrieve has a lawful basis for processing under the General Data Protection Regulation (GDPR) and any other applicable data protection legislation.

10 Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Creatinsta does not warrant that:

• The Service will be uninterrupted, error-free, or free of viruses;
• Data retrieved from Third-Party Platforms will be complete, accurate, or up to date;
• The Service will meet your specific business requirements.

To the maximum extent permitted by applicable law, Creatinsta's total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the greater of: (a) the fees paid by you to Creatinsta in the three months preceding the claim, or (b) EUR 100.

In no event shall Creatinsta be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, or data, even if advised of the possibility of such damages.

11 Term and Termination

These Terms remain in effect for as long as you have an active Account with the Service.

You may terminate your Account at any time by contacting Creatinsta at hello@creatinsta.agency. Upon termination, your access to the Service will cease and your data will be handled in accordance with the Privacy Policy.

Creatinsta may suspend or terminate your Account immediately and without prior notice if:

• You materially breach these Terms and fail to cure the breach within 7 days of written notice (where curable);
• You engage in conduct that Creatinsta reasonably believes poses a risk to the Service, other users, or third parties;
• Required to do so by law or court order.

Upon termination for any reason, all licences granted to you under these Terms immediately terminate. Provisions that by their nature should survive termination shall survive, including Sections 8, 10, and 13.

12 Modifications to Terms

Creatinsta reserves the right to update or modify these Terms at any time. We will notify you of material changes by email to the address associated with your Account, or by posting a notice within the Service, at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and terminate your Account.

13 Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions.

The parties agree to submit to the exclusive jurisdiction of the competent courts of Hungary for the resolution of any dispute arising from these Terms or the Service.

Before commencing formal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for at least 30 days following written notice of the dispute.
